Are we a good fit for mediation?
In my experience, most couples are a good fit for mediation – including high-conflict couples. You don’t have to agree on much (or get along well) to benefit from mediation; you just need a shared willingness to sit at the table and try to reach a practical agreement. When one spouse does not trust the other, mediation is still a viable option. Should it come to light that one person intentionally hid a significant asset or account during mediation, that lack of disclosure can be grounds to revisit or challenge the agreement with the help of independent counsel or the court. Mediation does not protect anyone who commits fraud; the same expectations of full disclosure that apply in adversarial litigation apply in mediation as well.
Can we each have separate attorneys to consult with during the mediation process?
Yes, although I mediate with the clients together only. Outside attorney review of the terms is always recommended for both parties once everything is agreed upon.
Do you offer virtual mediation sessions?
Yes, we offer virtual mediation sessions via Zoom to ensure accessibility for all clients, regardless of their location. This allows us to serve clients across the Greater Philadelphia region and throughout Pennsylvania, providing the same high-quality mediation services remotely.
What makes your mediation services unique?
Our boutique, concierge-style mediation services set us apart. We limit the number of clients we take on to ensure personalized attention, connections to other vetted professionals that may be needed by the clients and tailored solutions. We also offer flexible scheduling, including virtual sessions, to accommodate your needs and provide a high level of support throughout the process.
How long does the process generally take and what is the cost of mediation?
The length of the process depends on several factors, such as if there are children involved, level of financial entanglement, financial disclosure, etc. On average, it takes 2-4 months with 3-5 two-hour meetings to get to a signed agreement.
The cost is tied to the length of time of the mediation process, which again, is based on the specific needs of each couple. A flat-rate fee is determined after your initial complimentary zoom consultation. During the consultation, an assessment is made of your specific needs and a program is designed to produce the best outcome unique to each couple/family. When making the assessment, keeping costs down while ensuring the proper bases are covered are paramount. Our goal is to provide high quality services that are economically feasible for prospective clients. The predictable and fixed cost of the divorce process from the start (with no future surprises) is a major benefit to our clients facing financial uncertainty and fears.
We know that we want to get divorced, but is it too soon to start?
The sooner, the better. People often think they need to know what they will do in order to start, but often figuring out next steps and what is possible is part of our work together. Having the terms set doesn't mean the house has to be sold or one spouse has to move out by the time the agreement is signed. It just puts a plan in place that will begin when you both decide the timing is right for your situation. Mediation becomes more challenging after people start making decisions and dividing assets without proper guidance. Mediation also gets significantly more challenging when one or both partners start a new relationship, as decisions are then influenced by the new relationship rather than by what is best for each party as individuals and co-parents. Long story short-- it is never too early to begin. Starting off on the right foot in mediation helps to minimize anxiety, organize the chaos and promote a healthier long-term co-parenting relationship.
